My marriage visa is " under consideration" until Nov 10, when I have to go back to immigration. (Jomtiem). They also said they will be visiting our home.
My question is : Can I start using the 400K or are they likely to ask to see bank book again?

A question that may be asked is "what if I pull the money out anyway, and immigration declines my extension of stay?"
If your extension of stay is denied, you will have 7 days to leave Thailand. You can not apply for another in-country visa or extension of stay until you leave Thailand and return on another visa or visa exempt. An "extension of stay denied" stamp will have NO influence on returning to Thailand, or acquiring another extension of stay.
Do not touch one Thai baht of that 400,000 Thai baht deposit in your Thai bank account in your name only until the one year extension of stay as married to Thai is stamped into your passport.

This year, for the first time, Jomtien asked me to take a bank statement in during the under consideration period.

As a rule we suggest that people leave the 400K baht in their account until they actually get the year extension inked in. In fact Bangkok immigrations tells you to update the bank book and bring it in on the date you go back for the under consideration stamp to by changed to a year extension.
As far as I know Jomtien Immigrations does NOT have this rule but post on a Pattaya related f/b page to ask people who use that office for sure.
Last thing you need would be to get denied because you needed to keep the funds in there.
