Thank you for turning off comments to my post. Your black letter interpretation of what constitutes visa advice leaves something to be desired. As you could see from the comments there is some confusion as to how the law re an essential aspect of qualifying for retirement is interpreted. If this is not the correct forum, perhaps you can advise a more suitable one.
