Question about getting a non-i O visa through marriage - we're both Americans... My husband has a non-immigrant B visa through his Thai job. I'm ending my Thai job, then spending 3 months in the US, where I can apply for a future visa there, if needed.

Questions:

1. Can I enter Thailand on a visa-on-arrival, then apply for the non-i O using my husband's company HR to help?

2.  Would it be better to enter Thailand on a 90 day non-i O visa (that I could apply for in the US before returning to Thailand), then extend it for 1 year?

If you can get a new Non-O trailing spouse in Thailand after you enter on visa-exempt, it depends on how your husband's employer can provide the all required documents for the in-country process. In-country visa application would require more paperwork than the consulate visa process. You better to have your husband talk with the employer (HR people) if they can support the in-country process. if not, you need to apply for Non-O before you flying in.

You would be entering on a visa exempt, not a visa on arrival (there is a difference between the two). Either option would work, and would have the same result. I recommend talking to the company about it, to get their opinion. My opinion is to always get the visa you want OUTSIDE of Thailand, if possible.
